Personnel Decisions International Corporation (PDI) respects the privacy of the individuals who visit our website or request information. In general, individuals visiting PDI’s corporate website do so anonymously, without revealing any personal information.


Log Files
Like most standard website servers we use log files. This includes the name of the domain and host from which you access the Internet (for example, aol.com or princeton.edu); the Internet protocol (IP) address of the computer you are using; the browser software and operating system you use; the date and time you access our site; and the Internet address of the website from which you linked directly to our site. IP addresses, etc. are not linked to personally identifiable information.


Cookies 
PDI’s corporate website, www.personneldecisions.com, uses “cookies.” Cookies are small text files that a website transfers to your computer's hard drive. We may use cookies to measure traffic patterns, personalize content, control security and to help us make our site more useful. The cookies we use supply non-personally identifiable information, but may identify your OS version, browser and Internet specifications. You have the choice to accept, reject or be notified when a site sets a cookie by configuring your browser preferences.


Information Collection
PDI will not collect any personal information about you (that is, your name, address, telephone number, or e-mail address) unless you provide it to us voluntarily through visible means of data entry or collection. If you do not want your personal information collected, please do not submit it to us. You may supply information by responding to online surveys and registration pages, subscribing to our newsletters, placing an order on-line, or sending a e-mail to PDI. Please be aware that by using this site and sending information to PDI electronically, you consent to transborder and international transmission of any data that you may choose to supply us. Information transmissions to this site and e-mails sent to us may not be secure. Given the inherent operation and nature of the internet, all internet transmissions are done at your own risk.


Use of Information
The information PDI collects is used for the following purposes: 1) to improve the content of our website, 2) to notify customers about updates to our website, and 3) to contact customers for marketing purposes. Information collected through this site may be supplied to affiliates of PDI and other companies PDI has asked to perform work for us under contract. Though we make every effort to preserve user privacy, we may need to disclose personal information when required by law wherein we have a good-faith belief that such action is necessary to comply with a current judicial proceeding, a court order or legal process served on our website. In the event PDI goes through a business transition, such as a merger, being acquired by another company, or selling a portion of its assets, personal information collected under this policy will, in most instances, be part of the assets transferred. You will be notified via a notice on our website for 30 days prior to a change of ownership or control of such personal information. If as a result of the business transition, your personally identifiable information will be used in a manner different from that stated at the time of collection you will be given a choice consistent with our notification of changes section. PDI will not otherwise disclose your personal information to third parties without your permission, and we will take commercially appropriate measures to safeguard the personal information shared with us.


Security
This website takes every precaution to protect your information. When you submit sensitive information via the website, your information is protected both online and off-line.

When our order form asks you to enter sensitive information (such as credit card number and/or social security number), that information is encrypted and is protected with the best encryption software in the industry - SSL. Since our secure pages, such as our order form, are in frames, the lock icon with which you may be familiar does not appear. 

While we use SSL encryption to protect sensitive information online, we also do everything in our power to protect user-information off-line. All personal information, not just the sensitive information mentioned above, is restricted in our offices. Only employees who need the information to perform a specific job (for example, our billing clerk or a customer service representative) are granted access to personally identifiable information.

PDI reserves the right to change the terms of this Privacy Policy from time to time by posting an updated Privacy Policy. You are encouraged to review the posted Policy periodically for any changes or updates.

Data Privacy and Safe Harbor Compliance
PDI regards the lawful and correct treatment of personal information as being of utmost importance. Accordingly, it is PDI’s policy to comply with applicable international and country-specific data protection legislation at all times. While PDI has not self-certified to the U.S. Department of Commerce that it agrees to adhere to the safe harbor's requirements, PDI complies with the following safe harbor principles when personal data is collected during the provision of services to clients:

  • Notice: PDI notifies individuals about the purposes for which we collect and use information about them. We provide information about how individuals can contact us with any inquiries or complaints, the types of third parties to which we disclose the information and the choices and means we offers for limiting our use and disclosure of such information.
  • Choice: PDI gives individuals the opportunity to choose (opt out) whether to provide their personal information to PDI, whether their personal information will be disclosed to a third party or used for a purpose incompatible with the purpose for which it was originally collected or subsequently authorised by the individual.
  • Onward Transfer (Transfers to Third Parties, Transfer outside of the EU): Where PDI intends to transfer information to a third party that is acting as an agent, we either make sure that the third party will act in accordance with the safe harbor principles, or enter into a written agreement with such third party requiring that the third party provide at least the same level of data privacy protection as is required by the relevant principles contained in the Directive. In addition, where PDI intends to transfer the data outside of the EU, we make sure that the individual is fully notified of the transfer.
  • Access: PDI allows individuals to have reasonable access to personal information about them that PDI holds, and allow them to correct, amend, or delete that information where it is inaccurate, except where the burden or expense of providing access would be disproportionate to the risks to the individual's privacy in the case in question, or where the rights of persons other than the individual would be violated.
  • Security: PDI takes reasonable precautions to protect personal information from loss, misuse and unauthorized access, disclosure, alteration and destruction.
  • Data integrity: PDI ensures that personal information gathered is relevant for the purposes for which it is to be used. We take reasonable steps to ensure that data is reliable for its intended use, accurate, complete, and current.
  • Enforcement: Except as otherwise provided in a client contract, PDI agrees that if an individual invokes third-party beneficiary rights and/or claims compensation for damages, PDI will accept the decision of the individual to: 1) refer the dispute to mediation, by an independent person or, where applicable, by the supervisory authority; or 2) refer the dispute to the courts in the Member State in which PDI’s applicable subsidiary is established. PDI agrees that, by agreement with the individual, the resolution of a specific dispute can be referred to an arbitration body.

In addition to complying with the safe harbor principles, PDI has entered into contracts based on the model clauses drafted by the European Commission to satisfy the Directive, with each of its European subsidiaries in order to facilitate the exchange of personal data between its subsidiaries in Europe and its corporate offices in the U.S., including employee data and data gathered from PDI’s clients. EU based exporters or U.S. based importers of personal data can satisfy the adequacy requirement by including data privacy clauses in the contracts they sign with each other. The model clauses were created as an alternative means of compliance by American firms that are otherwise eligible to seek Safe Harbor certification, but chose not to do so. By signing the model clauses, PDI in the U.S. has agreed to meet EU privacy standards. The International Chamber of Commerce views the clauses as creating powerful and practical safeguards to protect privacy and fundamental rights of individuals where their data is transferred to countries without an established regime for the protection of personal data.
